Welcome to Travelshake.com. Travelshake.com provides access to the Travelshake.com website (the "website") and shows our content/products/services subject to the conditions set out on this page.
Please read these conditions carefully before using the Travelshake.com website. By using the Travelshake.com website, including signing up as an “owner” ("user") or “traveller” ("user"), you signify your agreement to be bound by these conditions. In addition, when you use any current or future Travelshake.com service, you will also be subject to the guidelines and conditions applicable to that service. The Travelshake Facebook App is a Facebook "plug-in" for Facebook page owners to show and replicate their content on Facebook.com from the Travelshake.com website.
Conditions of Use and Purpose
In the context of the internet and the website, the name 'Travelshake', refers to Travelshake.com or Travelshake Limited and gives no person, firm or body the right to use any of these names, in any format for any reason.
Eligibility and Registration
The website is limited to people over the age of 18. Children under age 18 may not submit content, materials or post to the website. Further, you may not submit any personally identifiable information of or about any child under the age of 13. Every tourism business user of such services is eligible to participate as a registered user of Travelshake.com. When registering or at a later stage, users can take part in our ezine (newsletter) update or may opt out of this service.
Once the sign up procedure is complete as a traveller, the user submits an offering via their email address to finalise the contract conforming to the use of services offered by Travelshake.com. Having signed up, the owner confirms that all information is correct and that they have permission from the business owner to represent the business. It is only possible to become a registered user of Travelshake.com if the user is legally competent or acts in accordance with their legal representative. According to the guidelines in the registration form, the user should be truthful and give complete details regarding their person and always keep these details up to date. It is not permitted to register under a pseudonym or an alias. Once a business profile is live, a Travelshake app for your Facebook page can also be installled by the admin/owner if you are an admin of it. As a Travelshake Facebook App can be installed to a 3rd party site, Travelshake cannot take responsibility for any information or does not assume any responsibility or liability for the actions, products, and content of other sites.
During the registration process the user, chooses a Business name and a password. Travelshake.com has the right to refuse, rename or delete any Business Name or URL extention associated to any business sign up that has been deemed incorrect or misleading to the public for representing a particular entity. When items such as videos, reviews, postings and comments are published on the website, the Business name is also published. The user is obliged to keep the password secret, to store it in a safe place, and to not allow any third party access to it. Should the password become known to any third parties, the user should immediately apply online to “forgot password” in order to have it reset, inform Travelshake.com online or by post to Travelshake Limited, 9 Willow Business Park, Dublin 12, so that a new password can be issued.
Once an owner’s account email has been confirmed and they activate the link their account is live on the website. Travelshake.com accepts the participation of the business owner by activating the owner's account immediately but will try and review all accounts within 24 hours.
In relation to paying for a premium Travelshake.com account including a Travelshake Facebook App and in order to ensure less administration is involved in renewing your account you agree to your Travelshake.com premium account and app to be renewed monthly, thus your credit/laser card will automatically be charged monthly, unless you instruct us to terminate the payment and your premium account. You simply notify our customer service department by email “accounts “at” travelshake “dot” com” of your decision to terminate your monthly paid account. You must cancel your monthly subscription before it renews in order to avoid billing of subscription fees for the monthly renewal on your credit/laser card. Termination of premium accounts and premium Travelshake Facebook Apps will be downgraded to the free basic Travelshake.com account and app when your current subscription expires.
User’s Conduct and Appropriate Content
Users must not use the website for any of the following:
- for fraudulent purposes, or in connection with a criminal offence or other unlawful activity;
- to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam" ;
- to cause annoyance, inconvenience or needless anxiety.
Some pages on Travelshake.com contain links to the websites of companies and other related businesses. We are not responsible for examining or evaluating, and we do not warrant or endorse the offerings of any of these businesses or individuals, or the content of their websites. Travelshake.com does not assume any responsibility or liability for the actions, products, and content of any of these and any other third-parties nor are we responsible or liable for the outcome or experience of a holiday after using Travelshake.com as a source of research. You should carefully review the privacy statements of other websites and other terms and conditions.
As a Travelshake.com user and account holder you may submit video content and text content ("such as forum posts"). Travelshake.com does not guarantee any confidentiality with respect to any videos and content. You shall be solely responsible for your own videos and content and the consequences of posting or publishing them and confirm that you represent, and/or warrant that you own or have the necessary licences, rights, consents, and permissions to use and authorise Travelshake.com to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all videos and content uploaded.
You retain all of your ownership rights to your videos and content but by submitting videos and content to Travelshake.com, you hereby grant Travelshake.com a worldwide, non-exclusive, royalty-free, sub-licenceable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the videos and content in connection with the Travelshake.com website and any Travelshake.com's business, including without limitation for promoting and redistributing part or all of the Travelshake.com website in any media formats and through any media channels. You also hereby grant visitors to the Travelshake.com website a non-exclusive license to access your videos and content through the website, and to use, reproduce, distribute, display and perform such videos and content as permitted through the functionality of the website.
The above licences granted by you in videos and content terminate within a commercially reasonable time after you remove or delete your videos and content from Travelshake.com. You understand and agree that videos and content may retain, but not display, distribute, or perform, server copies of videos and content that have been removed or deleted. The above licences granted by you in comments or post are perpetual and irrevocable. In connection with videos and content, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Travelshake.com all of the licence rights granted herein.
Travelshake.com does not endorse any videos and content or any opinion, recommendation, or advice expressed therein, and Travelshake.com expressly disclaims any and all liability in connection with videos and content. Travelshake.com does not permit copyright infringing activities and infringement of intellectual property rights on its website, and Travelshake.com will remove all videos and content if properly notified that such videos and content infringes on another's intellectual property rights. Travelshake.com reserves the right to remove videos and content without prior notice.
Changes to Travelshake.com and the Terms of Service
We reserve the right to make changes to our website, premium pricing, policies, and any of these terms and conditions at any time. You will be subject to the policies and the conditions of the terms and conditions in force at the time that you use the website, sign up or if you order items/services from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to services/content/orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. This will not prevent Travelshake.com from pursuing a claim for breach of contract, copyright infringement or otherwise in respect of these terms and conditions in any other jurisdiction throughout the world.
